Can AI “Invent” Patents?

AI has quickly become a jack-of-all-trades, capable of generating everything from recipes and vacation plans to computer code and even new drugs.

But can AI invent?

That's the burning question that legal scholars, patent authorities, and even Congress have been grappling with. A small but growing number of people believe that AI can indeed invent, challenging the long-held belief that only humans possess the ability to invent.

The U.S. Patent and Trademark Office recently hosted AI Inventorship Listening Sessions to delve into this matter. The Senate also held a hearing on AI and patents, with representatives from major technology and pharmaceutical companies alongside Dr. Ryan Abbott, the founder of the Artificial Inventor Project.

According to Abbott, the rapid advancement of AI distinguishes it from traditional tools used in inventions. Unlike a pencil or microscope, generative AI produces unscripted results, creatively stepping into the shoes of a person. The goal of AIP is to prevent AI innovations from being hidden as trade secrets, which would hinder progress in the field.

However, the general consensus among patent arbiters is that only humans can be considered inventors under current standards. The Artificial Inventor Project has encountered mixed results with patent authorities worldwide. While South Africa granted a patent for an AI-generated invention, countries like the US, Australia, and Taiwan rejected it.

To address the uncertainty surrounding AI and patents, Senators Chris Coons and Thom Tillis introduced a bill to clarify eligibility for patents. Although not specific to AI, the legislation recognizes the need for stronger patent protection for rapidly evolving technologies.

As AI continues to advance, the question of AI inventorship will become increasingly pressing. There is a growing consensus that AI will only improve its inventive capabilities over time. It remains to be seen how the legal landscape will evolve to accommodate AI-generated inventions.
