The lawsuit centers on the claim that OpenAI's ChatGPT and Microsoft’s Bing Chat, recently rebranded as Copilot, were trained on millions of articles from The New York Times. This training, the Times argues, has enabled these AI systems to generate content that competes directly with the publication, often providing users with information that closely mirrors or even directly excerpts the Times' articles. This situation is further complicated by instances where Bing Chat incorrectly attributed (hallucinated) information to The New York Times.
The lawsuit reveals intriguing details about the technical capabilities of GPT-4, which boasts a staggering 1.76 trillion parameters. This figure, not previously disclosed by OpenAI, represents a significant leap from GPT-2's 1.5 billion parameters. The Times' complaint also highlights the financial arrangement between OpenAI and Microsoft, noting that Microsoft is entitled to 75% of OpenAI's profits until its substantial $13 billion investment is fully repaid.
At the heart of the NYT’s argument is the assertion that their journalism provides "trustworthy information" in an information ecosystem rife with unreliable content. The publication is seeking billions of dollars in both statutory and actual damages, reflecting the perceived value of their copyrighted material and the potential revenue lost due to AI-generated content.
