Deep Dive: the EU AI Act
In April 2021, the European Commission introduced the first draft of a regulation known as AI-Reg-E. This regulation sets out rules for AI, aiming to establish a reliable framework for trustworthy AI while encouraging its development in Europe.
This regulation applies to anyone involved in creating or using an AI system in the EU – but it sets a standard for the entire world. Providers are those who develop or have an AI system developed for market use. Users are individuals or entities using an AI system, excluding personal, non-professional activities.
The regulation categorizes AI systems into four groups based on their functions, purposes, and usage circumstances.
Unacceptable risk - Certain applications are banned because they pose risks to fundamental rights. For instance, using AI to subliminally influence behavior or employing it in social scoring.
High risk - These are AI systems intended for safety-critical products or areas, such as medical devices or law enforcement. They must meet specific requirements before entering the market.
Special labeling for some AI systems - This applies to systems interacting with humans or generating authentic content. Users must be informed when interacting with them.
Minimal risk - These AI systems have no specific regulations. Providers can establish voluntary codes of conduct to promote best practices.
For high-risk AI systems, several requirements must be met:
Risk management - A documented system for minimizing risks.
Data quality - Only quality data should be used for training and operation.
Technical documentation - Detailed documentation to demonstrate compliance.
Obligation to keep records - Operations must be documented and stored according to GDPR rules.
Transparency - The AI system's operation should be clear to users.
Human supervision - The system should be designed for human supervision.
Accuracy, robustness, and cybersecurity - The AI system must be protected against errors and unauthorized access.
Providers must ensure their AI systems meet requirements and undergo conformity assessments. Users must follow provided instructions and monitor system operations. Member states will establish supervisory authorities. Additionally, a European Data Protection and Intelligence Committee will provide guidance.
Fines for violations can be substantial, up to 4% of a company's global annual turnover, or even higher for certain violations.
The EU AI Act is in the final stages of negotiation. While there may be some adjustments, the framework is expected to remain largely intact. The regulation aims to create a safe and reliable environment for AI development and usage in Europe.
