FTC investigating OpenAI on ChatGPT data collection and publication of false information

The Federal Trade Commission (FTC) is investigating OpenAI, the creator of ChatGPT, over concerns of consumer harm due to data collection and the dissemination of false information. The FTC has sent a 20-page letter to OpenAI requesting information about the development and training of its language models, as well as data security measures.

In February, the FTC established an Office of Technology to address misleading claims in the tech sector. They emphasized that companies making AI-related claims must adhere to truth requirements like anyone else, warning them to keep their claims in check or face consequences from the FTC.

The FTC is specifically interested in understanding how OpenAI verifies the information used to train its models and how it prevents false claims from being shown to ChatGPT users. They also want to know more about how APIs connect to OpenAI's systems and how data is protected when accessed by third parties.

This investigation marks the first major inquiry into OpenAI in the United States.

The FTC has previously expressed its intention to regulate AI, including warning against the use of biased algorithms. A watchdog organization called on the FTC to prevent OpenAI from launching new GPT models earlier this year.

Large language models like ChatGPT can sometimes generate inaccurate information. OpenAI acknowledges this and advises users that incorrect facts may occasionally be produced. Similar issues have been observed with other language models like Google's Bard. Instances have also been reported where individuals faced consequences for using ChatGPT, such as a lawyer being sanctioned for submitting fake cases and a radio host suing OpenAI for results that falsely claimed he was involved in embezzlement.

US lawmakers have shown considerable interest in AI, both in understanding the technology and exploring the possibility of implementing regulations. The Biden administration has released a plan to establish responsible frameworks for AI development and has invested $140 million in research centers. Even Supreme Court Justice Neil Gorsuch has discussed the legal liability of chatbots.

Against this backdrop, OpenAI CEO Sam Altman has been engaging with lawmakers in Washington, advocating for AI regulations.
