Microsoft Says It Will Defend AI Users From Copyright Lawsuits

In a bid to reassure its users, Microsoft has announced a commitment to shield buyers of its AI products from potential copyright infringement lawsuits. This move comes as a response to concerns surrounding the use of Microsoft's AI "Copilots" to create content based on existing works.

Hossein Nowbar, General Counsel at Microsoft, explained it all in a new blog post. He assured customers that they would be safeguarded as long as they used the guardrails and content filters integrated into the company's products. Microsoft also went a step further, promising to cover any fines or settlements related to copyright issues.

Microsoft's Chief Legal Officer, Brad Smith, emphasized the company's commitment to stand by its customers in the face of potential legal challenges. The Copilot Copyright Commitment, he explained, was an extension of their broader AI customer commitments announced earlier in the year.

The decision to assume legal responsibility for potential copyright infringement claims stems from three key considerations. Microsoft aims to support its customers, acknowledging the concerns of copyright holders, while also implementing robust measures to prevent any unintentional infringement of copyrighted material.

Smith articulated that one of the primary motivations behind this commitment was to address uncertainties in copyright law without discouraging people from using generative AI services. He stressed the importance of authors retaining control over their rights while also ensuring that crucial content for training AI models remains accessible and doesn't become monopolized.

Microsoft introduced a suite of generative AI tools under the name "Copilot." This technology, which first debuted with GitHub Copilot in June 2022, enables users to write code efficiently. Today, Copilot is seamlessly integrated into various Microsoft products, including Windows 11, the Edge browser, Teams, and Outlook, among others.

It's worth noting that Microsoft, GitHub, and OpenAI are currently entangled in a lawsuit, with allegations that Copilot may reproduce licensed code without crediting the original creators. Authors and visual artists have also filed lawsuits claiming that AI companies unlawfully utilized their work to train generative AI models.
